The firm was able to obtain a settlement for an employee of a construction company who was discriminatorily discharged due to a medical condition. The Client’s employment was terminated while he was on FMLA leave for his medical condition. Tom Horgan, partner at Orr & Horgan, was able to obtain a six-figure settlement from the Client’s employer for discriminatory practices in violation of state and federal law.

The firm was able to obtain a settlement for an employee of an agriculture company who was terminated from his employment while never receiving commission payments. The Client was owed thousands of dollars in unpaid commission payments. Tom Horgan, partner at Orr & Horgan, was able to obtain a pre-suit settlement from the Client’s employer for violations of Nebraska’s Wage Payment and Collection Act.

The firm was able to obtain a settlement for a husband and wife who were severely injured in a motor vehicle accident with an uninsured at-fault driver. The firm was able to appoint a temporary and permanent guardianship and conservatorship over an elderly individual diagnosed with Alzheimer’s Disease. After significant discovery and motion practice, the firm was able to accomplish what the Clients sought from the beginning of the contested estate. Tom Horgan, partner at Orr & Horgan, obtained a pre-hearing dismissal in Sarpy County District Court on a school-choice dispute between two parents. The parties were divorced in 2013 with a parenting plan outlined the parties’ rights. The Parenting Plan contained a clause that stated the mother’s residence will serve as the primary residence for the child’s education. Opposing counsel filed a motion requesting the Court hear the dispute and to decide where the child will attend school. Tom was able to obtain a pre-hearing dismissal for lack of jurisdiction on the basis that the motion was improper.

Obtained Summary Judgment

Homeowners Association pursuant to Nebraska Revised Statute 52-001

Connor Orr and Tom Horgan, partners at Orr & Horgan, obtained a summary judgment decision in Lancaster County, Nebraska, on behalf of a Homeowners Association pursuant to Nebraska Revised Statute 52-001. After significant motion practice, Connor argued the summary judgment motion and was able to obtain successful results on behalf of the client, including full recovery of damages and attorney’s fees.

Orr & Horgan obtained a settlement for an individual who was injured while in her apartment. Tom Horgan, partner at Orr & Horgan, was able to obtain a settlement from the Client’s landlord who initially denied liability, offered no money to settle the claim, and asked that she move out of her apartment.
